As soon as one guy figured out they knew about the second defect there would either be a major class actions from big firms in each state or a ton of individual cases around the country for them to deal with, and either way it would be extremely expensive for them just to litigate, to say nothing of the settlements which could be easily be over a million dollars per case for non-class actions depending on the area of the country and the injuries. I am an attorney who does some plaintiffs product liability litigation, and if even one of those new jack stands failed and there was evidence the company knew about the replacement version defects and did nothing about it, that would be a dream case, with the perfect storm of big damages (death or major permanent injuries), a big pocket target, a previous recall, and the type of corporate wrongdoing that really pisses off a jury and exposes the company to punitive damages in most states, which can be extraordinary leverage for plaintiffs.
